DMCA Copyright Policy
Copyright owners can ask Tees Geek to remove material that infringes their work. This page explains the notice and counter-notice process.
1. Policy statement
Tees Geek does not intend to offer infringing material. If you believe a product, image or other content on teesgeek.com infringes a copyright you own or represent, send a notice as described below. We act under the notice-and-takedown procedure of the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.
2. Required notice elements
A notice must be in writing and contain each of these items:
- Signature. Handwritten or electronic, by the rights holder or by someone entitled to act for them.
- The work. Which copyrighted work you say was copied. One notice may cover several works by way of a representative list.
- The material. What on our site you say infringes, with enough detail to locate it, including the full URL of each page concerned.
- Your details. Name, mailing address, telephone number and email address.
- Good-faith statement. Your declaration of a good-faith belief that the use described has authorization from neither the rights holder, nor its agent, nor the law.
- Accuracy and authority. Confirmation that the notice is accurate, plus a statement under penalty of perjury confirming you are the owner of the right concerned or are authorized to act for that owner.
3. Copyright agent
Address notices to Tees Geek, Attn: Copyright Agent, by email at [email protected] with the subject line “DMCA Notice”. Our full contact record appears at the end of this page.
4. Handling of notices
We review each complete notice promptly. Where material appears to infringe, it is removed or access to it is disabled, and the person who provided it is notified where applicable.
5. Counter-notice
Counter-notices go to the same email address. Use one when you believe material was taken down in error. Include:
- Signature. Your physical or electronic signature.
- Removed material. A description of what was taken down or disabled, and where it appeared before removal.
- Sworn statement. Under penalty of perjury, you state your good-faith belief that a mistake, or misidentification of the material, caused its removal or disabling.
- Identity and consent. Your name, address and telephone number. A statement consenting to jurisdiction of the federal district court covering your address, or, if you live outside the United States, of any federal judicial district where Tees Geek may be found. A statement agreeing to accept service of process from the complainant who sent the original notice, or from that complainant’s agent.
We may forward a valid counter-notice to the original complainant and restore the material as Section 512(g) allows, unless that party tells us it has started a court action.
6. Repeat infringement
Any party responsible for repeated infringement has its material removed and its business relationship with Tees Geek ended.
7. False or misleading notices
Section 512(f) of the DMCA makes a person who knowingly and materially misrepresents either infringement (in a notice) or a mistaken removal (in a counter-notice) liable for the resulting damages, including costs and attorneys’ fees.
